High Court of Bombay in its Order, dated 11-06-2010 Treating RTPs with all consequential benefits including seniority and pay fixation

Employees recruited as Postal Assistant in Reserve Trainee Pool Scheme(RTPS) of Postal Department are entitled to be paid the same salary and emoluments per mensem as are being reserved by the Postal Assistant wef the date of their appointment other benefits are subject to their regular absorption in the Postal Department.


Facts: There are 9 Applicants who are Postal Assistant in the Reserve Trainee Pool of Postal Department earlier, they filled an O.A. which was disposed by the Tribunal with a direction to the Respondents to grant the Applicants benefit of regularization, seniority, pay scale, etc. from the initial date they were appointed as P.A. under the reserve Trainee Pool Scheme. That order was passed on the basis of earlier order of Jabalpur Bench of the Tribunal in O.A. NO.82 of 1986,dated 16-12-1986.That order was challenged in High Court which remitted the case back to Tribunal to give separate reasons for regularization ,seniority and salary from the date of their appointment under the Pool Scheme. In view of the above, the earlier order of the Tribunal was reconsidered in the review. But the Applicants were not present. Respondents were heard.

All the nine applicants were appointed as P.A. under the RTP Scheme in 1980.That scheme was withdrawn in 1986. But before that some RTP persons approached the Jabalpur Bench of the Tribunal by the filing T.A. No. 82 of 1986 for the relief which as allowed. That TA was disposed of by Jabalpur Bench. The important point to be noted in the order at para.13 concisely are; (i) To review the policy to stop recruitment/ absorption of person against regular Postal Assistant(ii) None are inducted as P.A. from other wing of Postal Department till the petitioners therein are absorbed against regular posts(iii) No fresh appointment of RTP are made till the policy of recruitment is reserved (iv) The cases of the applicants are considered for absorption on the basis of Circular, dated 30.10.1980 by forming a Screening Committee. Further it was held to keep parity of the RTPs with Postal Assistant in regular posts in regards to salary, etc. The Provision of Circular, dated 30.10.1980 in so far it relates to payment of hourly rates of wages to employees in RTP is discriminatory and violative of Articles 14 and 16 of the constitution. RTP are to be paid the same salary and allowances as was given to Postal Assistants. This order is subject to regular absorption of those RTPs.

The above orders when challenged it was dismissed by Supreme Court also.

The main oreder in T.A. NO.82 of 1986 filed in Jabalpur Bench is the direction of the respondents to treat the Applicants(RTPs) as regular Postal Assistant form the date of their appointment as RTP with all consequential benefits of seniority, pay fixation. They are allowed monetary benefits from the date of filing this O.A.

The Tribunal reconsidered their earlier orders. The Jabalpur Bench in T.A. No.82 of 1986 granted salary and emoluments to be paid to RTPs same as regular P.A. from the date of their appointment. But the Bombay Bench in respect of 9 Applicants herein to treat them as P.A. from the date of their appointment under RTP Scheme with all consequential benefits including seniority and pay fixation. To this extent there is a contradiction in the order of the Bombay Bench.

The Appointment of RTPs herein appointed long back is not disputed. Evidently all the Applicants herein were granted all the consequential benefits from the date of absorption, admitting that the Applicants herein are placed similar to Applicants in O.A. No.82 of 1986.With the above details, the reconsideration of these case as ordered by the High Court of Bombay in its Order, dated 11-06-2010, these OAs are allowed by directing the Respondents to extend the present nine Applicants same relief as granted to the Applicant in T.A. No.82 of 1986 decided by Jaballpur Bench on 16-12-1986 and upheld by Supreme Court by Order, dated 11-05-1988 by dismissing the SLP No. 11313 of 1987 preferred by Union of India against the order of Jabalpur Bench of Tribunal.

Thus all nine OAs are partly allowed in the terms of the above direction.

SOMETHING TO BE CLARIFIED - SOME KNOWS TO KNOW

                           REGULARISATION OF UNAUTHORISED ABSENCE

Department of Personnel and Training has issued following Consolidated instructions on Regularization of Unauthorized Absence.

As per Rule 25 of CCS (Leave) Rules 1972:

• Unless the authority competent to grant leave extends the leave, a Government servant who remains absent after the end of leave is entitled to no leave salary for the period of such absence and that period shall be debited against leave account as though it were half pay leave, to the extent such leave is due, the period in excess of such leave due being treated as extraordinary leave.

• Willful absence from duty after the expiry of leave renders a Government servant liable to disciplinary action. Government of India decisions also exists that a Government Servant who remains absent without any authority should be proceeded against immediately and this should not be put off till the absence exceeds the limit prescribed in Rule 32(2) (a) of the CCS (Leave) Rules, 1972.

• It is once again stressed that a Govt. servant who remains absent without any authority should be proceeded against immediately. Ministries/Departments are requested to ensure that in all cases of unauthorized absence by a Government Servant, he should be informed of the consequences of such absence and be directed to rejoin duty immediately within a specified date, say within three days, failing which he would be liable: for disciplinary action under CCS(CCA) Rules 1965. If the Government Servant does not join duty by the stipulated date the Disciplinary Authority should initiate disciplinary action against him and the disciplinary case should be conducted and concluded as quickly as possible.

• It is only due to apathy of the Disciplinary Authorities that the situation arises where long pending unauthorized absence leads to delay in other service matters of Government Servants, including promotions. To avoid such situations all Ministries Departments should advise Disciplinary Authorities to ensure that prompt action is taken against Government Servants who absent themselves without permission and that Charge-Sheets are issued without delay.

• The consequences and procedure to be followed in respect of an officer who is absent from duty without any authority has been brought out under FR 17(1 ) and 17-A. As per FR 17-A(iii) without prejudice to the provisions of Rule 27 of the Central Civil Services (Pension) Rules, 1972, remaining absent without any authority or deserting the post, shall be deemed to cause an interruption or break in the service of the employee, unless otherwise decided by the competent authority for the purpose of leave travel concession, quasi-permanency and eligibility for appearing in department examinations, for which a minimum period of continuous service is required.

• Comptroller and Auditor General have issued orders that the period of absence not covered by grant of leave shall have to be treated as “dies non” for all purpose; viz., increment, leave and pension. Such absence without leave where it stands singly and not in continuation of any authorized leave of absence will constitute an interruption of service for the purpose of pension and unless the pension sanctioning authority exercise its powers under Article 421, Civil Service Regulations [now Rule 27 of the CCS (pension) Rules] to treat the period as leave without allowance, the entire past service will stand forfeited.

• It may be noted that regularization of unauthorized absence for pension purpose is to be considered under the CCS (Pension) Rules. Only in cases where the disciplinary authority is satisfied that the grounds adduced for unauthorized absence are justified, the leave of the kind applied for and due and admissible may be granted to him under the CCS (Leave) Rules.

Anil Ambani group firm Reliance Money Infrastructure Ltd said on Monday it has sold 1,000 kg gold coins till November and aims to double sales by March end.

"The one tonne gold coins sales landmark, valued at over Rs 200 crore (Rs 2 billion), in less than nine months is a testimony to the trust and confidence our customers have bestowed in us and our offerings," RMIL director Vikrant Gugnani said.

The company, which is bullish on its growth prospects, plans to double the gold coin sales from the current 1,000 kg by the end of the current financial year.

"We are bullish on the demand of gold coins in months ahead and aim to cross 2,000 kg gold coins sales mark by March 31, 2011. We see gifting market growing in high double-digits and hope to be a dominant player in this segment," Gugnani said.

With the yellow metal gaining popularity as a preferred asset class among investors, the company has sold over Rs 500 kg of gold coins during the festive season between October and November.

At present, the company's sells gold coins in the range of 0.5 gram, 1 gram, 5 grams, 8 and 20 grams denominations that are sold through 700 post offices as part of its tie-up with India Post -- across the country.

RMIL plans to further strengthen its gold portfolio and distribution reach and is expecting increase in demand from retail and corporate customers.

To match up with the rising demand, the company aims at extending its distribution reach to 1,000 India Post offices next year, from the present over 700 post offices.

"We aim to be the largest gold coin retailer in a span of two years," Gugnani said. Besides India Post, the entire range of pure gold coins would also be available across Reliance Money, Reliance World and the companys partner outlets across the country.

1. Can the ACP/MACP denied to those who had refused regular 
     promotion ?

For ACP : (from clarification issued for ACP) “The ACP Scheme has been introduced to provide relief in cases of acute stagnation where the employees, despite being eligible for promotion in all respects, are deprived of regular promotion for long periods due to non-availability of vacancies in the higher grade. Cases of holders of isolated posts have also been covered under ACPS, as they do not have any promotional avenues. However, where a promotion has been offered before the employee could be considered for grant of benefit under ACPS but he refuses to accept such promotion, then he cannot be said to be stagnating as he has opted to remain in the existing grade on his own volition. As such, there is no case for grant of ACPS in such cases. The official can be considered for regular promotion again after the necessary debarment period”.



For MACP (from MACP Order) “ lf a regular promotion has been offered but was refused by the employee before becoming entitled to a financial up-gradation, no financial up-gradation shall be allowed as such an employee has not been stagnated due to lack of opportunities. If, however, financial up-gradation has been allowed due to stagnation and the employees subsequently refuse the promotion, it shall not be a ground to withdraw the financial up-gradation. He shall, however, not be eligible to be considered for further financial up-gradation till he agrees to be considered for promotion again and the second the next financial up-gradation shall also be deferred to the extent of period of debarment due to the refusal”.

As per DOPT instruction, grading of APAR should be disclosed to the official concerned. does it mean that photocopy of the APAR should be given to the individual. Is there any format prescribed (covering letter) for disclosure of APAR ?

"Full APAR" is to be communicated. Hence it should be a Photostat copy.


3. Can Govt dues be adjusted against final payment of GPF with the consent of a Govt servant ?


Never come across any such restriction. Moreover, when GPF become due as final payment it is employees booty which he may consensually get adjusted in regard to outstanding govt. dues.

Allotment of residences on re-posting at the last place of posting

Directorate of Estates Office Memorandum No. 12035/21/95-Pol.II dated 10.08.2010

Directorate’s O.M. of even number dated the 31st July, 2000, provides for regularization of the accommodation in case of re-posting within a period of one year i.e. within four months after the permissible retention period of eight months in the case of transfer. The above referred O.M. also provides for regularisation of the house in case of re-posting within a period of four months beyond the permissible period of eight months by charging double rate of normal licence fee even though the date of priority of the officer is not covered. This has created an anomalous situation because an officer vacating the house after eight months is charged at damage rate whereas on the other hand in the case of re-posting an officer is charged only double the normal rate up to a period of one year from the date of transfer.


This position was re-considered by the Directorate and it has been decided that henceforth regularisation in the case of re-posting will be regulated as under;


• Regularization will be considered only in cases where re-posting takes place within the permissible retention period of eight months (two months on normal licence fee and six months on double the normal licence fee on medical/educational grounds).


• Retention beyond the permissible retention period will be treated as unauthorized and charged at damage rate.


• In cases, where re-posting in eligible organization takes place beyond the permissible period of retention of eight months, damage rate of licence fee will be charged for the period beyond eight months and regularisation will be allowed only if the date of priority is covered.

இதுகுறித்து, சென்னை மாநகர மண்டல தபால் துறைத் தலைவர் ராமானுஜன் கூறியதாவது: கடந்த நிதியாண்டில், எட்டாயிரம் கோடி ரூபாய் நஷ்டம் ஏற்பட்டுள்ளது. இதை ஈடுகட்ட, "ரீடெய்ல் போஸ்ட்'ன் கீழ் மற்ற பணிகளை மேற்கொண்டு வருவாயை ஈட்டும் முயற்சியில் ஈடுபடுகிறோம். அரசின் அனைத்து துறை சார்ந்த விண்ணப்ப படிவங்களை பெற, மக்கள் சம்பந்தப்பட்ட அலுவலகங்களில் காத்திருத்து பெறும் நிலை உள்ளது. ரேஷன் கார்டு, இறப்பு சான்றிதழ் உள்ளிட்ட அரசு துறை சார்ந்த அனைத்து விண்ணப்ப படிவங்களையும் தபால் நிலையத்திலேயே எளிதில் பெறும் புதிய திட்டம், தபால் துறை தமிழக வட்டத்தில் அறிமுகப்படுத்தப்படுகிறது. இந்த வசதியை ஆக., 15 முதல் மக்கள் பெறலாம். இவ்வாறு ராமானுஜன் கூறினார்.

In order to assess the financial implications, Heads of Circle were requested to furnish the information of the implications, Heads of Circle were requested to furnish the information of the number of such Grmain Dak Sevaks absorbed against Departmental posts from year 2006 to 2010 calendar year-wise.

Attention of all concerned is invited to Annexure-III of this Directorate order No. 6-1/2009-PE.II dated 08.10.2009 containing details of existing and revised benefits under nature of benefit named 'Severance Amount'.

2. In this context, it is to clarify that the present benefit shown against Severance Amount also includes Severance Amount on absorption on regular posts payable @ Rs. 20000/- (Rs. Twenty thousand only) to an EDA (now called GDS) absorbed on regular basis against a departmental post after 15 years of continuous service as ED Agent (now called GDS) in the light of the common recommendation made by the GDS Committee in Para 14.14.1. Therefore, the revised benefit indicated against nature of benefit 'Severance Amount' is applicable not only on retirement/death but also on absorption against departmental posts @ Rs. 1500 for every completed year of service subject to maximum of Rs. 60000 with reduction in minimum eligibility to 10 years.

3. Therefore, the words "Severance Amount on retirement/death" may be taken as inserted on the top as headline above the existing para under present benefits against 'Severance Amount' starting with "A lump sum severance amount and ending with amount paid is Rs. 20000." Below this para, a new headline as "Severance Amount on absorption on regular posts" & a para beneath it starting as "Severance amount of Rs. 20000 (Rs. Twenty thousand only) is paid on absorption on regular basis against a departmental post after 15 years of continuous service" may also be taken as inserted & accordingly the Annexure III to this Directorate Order No. 6-1/2009-PE II dated 09 Oct 2009 may be taken as amended. Revised Annexure III to this Directorate Order ibid is appended below:-

Present benefits:-
Granted at the rate of half months basis TRCA drown immediately before discharge of service for each completed year of service subject to maximum of Rs. 18000 or 16.5 months basic TRCA last drawn whichever is less. Minimum service prescribed is 10 years.

Revised Benefits:-
Continuance of the existing formula for grant Ex-gratis Gratuity subject to a maximum of Rs. 60000.

                                                    Severance Amount :-
Present benefits:-

1.Severance Amount on retirement/death

A lump sum severance amount of Rs. 30000/- is paid on discharge provided a GDS has completed 20 years of continuous service. In case of a GDS completing 15 years of service but less than 20 years of continuous service the severance amount paid is Rs. 20000/-.

2.Severance Amount on absorption on regular post

Severance amount of Rs. 20000 (Rs. Twenty thousand only) is paid on absorption on regular basis against a departmental post after 15 years of continuous service

Revised benefits for both:-

Severance amount shall be paid at the rate of Rs. 1500/- for every completed year of service subject to a maximum of Rs. 60000/- with reduction in minimum eligibility period to 10 years.

3. This may be brought to the notice of all concerned. This has the approval of the competent authority.
