AIPEU GROUP 'C' HOLDS ITS CWC AT AJMER [RAJASTHAN] FROM 26th to 27th MARCH 2010































































OUR CWC MEETING AT AJMER RAJASTHAN WAS SUCCESSFULLY HELD FROM 26TH TO 27TH MARCH 2010

CWC DECIDED TO INTENSIFY THE VERIFICATION CAMPAIGN - LAUNCH AGITATION INCLUDING DIRECT ACTION AFTER TAKING A DECISION IN THE ENSUING NFPE FEDERAL COUNCIL AT NEW DELHI.

CWC WAS INAUGURATED BY THE SECRETARY GENERAL NFPE AND THE PMG AJMER ATTENED AS A SPECIAL GUEST.

GENERAL SECRETARIES OF P4, R3, R4, ADMN AND GDS UNIONS PARTICIPATED AND ADDRESSED - SENIOR LEADERS INCLUDING COMRADES B.G.TAMHANKAR [FORMER NFPE PRESIDENT]; R.N.CHAUDHARY [FORMER GS P3]; AND SANKAR KHADUSKAR [FORMER VP P3 CHQ]; ADDRESSED.

CWC was presented by a written work report by Comrade K.V.Sridharan General Secretary P3 and after discussion on it the CWC decided to go for direct action after taking appropriate decisions in the ensuing NFPE Federal Council in June 2010. CWC decided to intensify the membership drive in the ongoing verification process.
ALL DECISIONS TAKEN IN THE CWC WILL BE CIRCULATED SHORTLY THROUGH OUR CIRCULAR.

OFFICE MEMORANDUM

Subject:- Payment of Dearness Allowance to Central Government Employees - Revised Rates effective from 1.1.2010.

The undersigned is directed to refer to this Ministry's Office Memorandum No.1(6)/2009-E-II(B)dated 18th September, 2009 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced form the existing rate of 27% to 35% with effect from 1st January, 2010.

2. The provisions contained in paras 3, 4 and 5 of this Ministry's O.M. No.1(3)/2008-E-II (B) dated 29th August, 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.

3. The additional instalment of Dearness Allowance payable under these orders shall be paid in cash to all Central Government employees.

4. The payment of arrears of Dearness Allowance for the month of January and February, 2010 shall not be made before the date of disbursement of salary for March, 2010.

5. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In regard to Armed Forces personnel and Railway employees separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.

6. In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders issue after consultation with the Comptroller and Audit General of India.

Govt employees can travel first class from April 1
With signs of economic revival becoming more pronounced, the government has relaxed the austerity drive undertaken last year and from April 1, government employees will be allowed to fly first class.
"The matter has been reviewed and it has been decided that with effect from April 1, 2010, travel on government account by air, both domestic and international may take place by the entitled class," an official statement said.
Last September, in the midst of the global financial crisis, the government had directed its employees not to fly first class on government account, irrespective of their entitlement, and fly economy for all domestic travels. However, the government has not relaxed the austerity directive in case of Leave Travel Concession (LTC). "...austerity measures will remain in place for travel by air (where admissible) on LTC, which would continue to be restricted to economy class irrespective of the entitlement," the Finance Ministry statement said.
The Indian economy slowed down in 2008-09 after being hit by the global financial crisis triggered by the collapse of US investment bank Lehman Brothers and other Wall Street titans beginning September 2008. The country grew at a subdued rate of 6.7 per cent in 2008-09 after growing at around 9 per cent per annum for the preceding three financial years. In 2009-10, the economy is projected to grow by 7.2 per cent and by 8.5 per cent in 2010-11.

VIII FEDERAL COUNCIL OF NFPE

Dear Comrades,

The Federal Secretariat of NFPE has met on 3rd March 2010 and decided to hold the next Federal Council of NFPE in New Delhi in the month of June 2010. After considering the feasibility of holding it some other circle and taking into account of all the factors including the time constraint, requirement of collection of funds for holding the Council etc, the Secretariat has decided that the Headquarters itself will hold the Federal Council in the Capital City with the cooperation of all Circles and Divisions and Branches of our great organisation.

Make it another Milestone

You are aware that every Session of the Federal Council of our Federation since its inception as NFPE and since the historical existence as NFPTE was always very important and our sessions had led to several historic decisions that set the tone of the entire movement of Postal Employees in a particular direction and course. Even the decisions arrived at in our Federal Council sessions had impacted the decisions of the entire Confederation of Central Government Employees movement in the past. In that background, we are confident that the ensuing 8th Federal Council of NFPE will also become a milestone in the history of Postal Employees movement. We meet in the background of stark advancement in some areas but with unresolved issues in some other areas. The Federal Council will consider in depth the whole scenario and will arrive at direction for our future march forward.

Venue and Preparations

The venue of the Federal Council is fixed at the Muktadhara Air-conditioned Auditorium with 200 seated capacities in Gole Market area of New Delhi keeping in mind the summer climate in the capital at that time. The ambience of the auditorium will provide a nice atmosphere for deep discussion on all issues by the members of Federal Council. Arrangement for stay with proper room and bedding with north & south Indian food for all Federal Councillors and Visitors are being made. Leaders of Trade Unions Centres and Central and State Government Employees movement will address the inaugural session of the Council.

Advertisements for Souvenir for raising Funds to hold the Council

To meet out the expenditure of the Federal Council and to commemorate the historic occasion, it has been decided to bring out a colourful souvenir. The Secretariat requests all Circle and Divisional / Branch Secretaries to extend total cooperation by procuring maximum number of advertisements from each division / branch. Direct cash donations to the Federal Council of NFPE from branches and divisions are also requested. Tariff for advertisement is under preparation and will be despatched to all shortly. A 20% discount on the tariff amount for procuring advertisements by the branches and divisions will be allowed. Without the cooperation of circles and divisions this huge task of holding the federal council will not be possible. NFPE headquarters pins its confidence on the circles and divisions and branch unions that they will rise up to the occasion in a befitting manner.

Re-verification

The Secretariat reviewed the decision for holding joint circle council meetings and the inability of several circles in holding the same due to their preoccupation with the hectic re-verification campaign under way in their circles. It has been therefore decided that those circles who desire to continue their own programmes for this task may be permitted to follow their own programmes. However, the Secretariat calls upon all Circle Secretaries to take a close look into the activities of all divisions and branches under them and guide them in proper way to overcome any weakness visible. It is not an exaggeration that in some circles our own organisational weaknesses are impacting on the task of collecting maximum declaration forms from members. We should not lag behind in our task of emerging as the single largest organisation in each cadre. All P3 leaders are requested to extend a helping hand for our 'All India Postal SBCO Employees Association' in its task of emerging as a vital organisation. Recently the SBCO Association has got a booster in the decision of Indian Postal SBCO Staff Association merging to a form a stronger Association for the interests of SBCO Cadre. Tell every employee that without a stronger NFPE it would not be possible to rein in the bureaucracy that wants to do everything unilaterally and arbitrarily. The future of postal employees will be safe only by further strengthening the NFPE Unions and Associations.

National Anomaly Committee Meeting

National Anomaly Committee meeting official minutes has been released without incorporating certain corrections desired by the Staff Side. On important issues like grant of one increment in the pre-revised scale of pay on 1.1.2006 for all those employees whose increment falls between February and June; and Fixing the pay of senior Promotee employees at least on the level of pay recommended for direct recruited employees after 1.1.2006, we could see the official side not much interested to bring about solutions. The Railway Department in the meanwhile issued an order for stepping up the pay of such seniors to the level of new recruits if any entered into service after 1.1.2006 but denied the benefit if no new recruitment was made in the cadre after 1.1.2006. NFPE has taken up the issue with the Confederation for appropriate action. Meanwhile, the next meeting of National Anomaly Committee is likely to be held on 27.03.2010.

Departmental Anomaly Committee Meeting

The Departmental Anomaly Committee Meeting Minutes are under circulation for finalisation. It has been agreed to by the Committee to fix the Grade pay of BCR Group D at the level of 1900 GP from 1.1.2006. It has been agreed to for taking up with the Nodal Ministry for treating the Special Allowance of PO&RMS Accountants as part of basic pay while pay fixation but otherwise the higher pay for PO&RMS has not been accepted as an anomaly. Many issues we raised are turned down on the grounds that they are not anomaly of 6th pay commission. The parity with Telecom Assistants for TBOP and BCR scale of pay is not accepted except for assurance that the department will examine the higher pay for LSG Supervisor outside the Anomaly Committee. Technical Postal Assistant issue is turned down as it has been declared as a dying cadre and converted into a PA Cadre but assured that the issue may be taken up for consideration outside the Anomaly Committee. The Anomaly Committee accepted to recommend higher pay for Drivers on par with the Postmen / Mailguard to DOPT. The Staff Side is writing to the Chairman Anomaly Committee for inclusion of higher pay scales for Artisans also along with Drivers since the understanding of the Anomaly Committee about the direction of the Madras High Court seems to be incorrect. Data Entry Operator issue is also not accepted as an anomaly of 6th CPC since there is no official existence of the cadre in DoP. Parity between PO Treasurer and RMS Cashiers will be taken up with Nodal Ministry. Higher Pay for Sorters in DAP also not agreed to as an anomaly. System Administrators and Marketing Executives issue is also not agreeable to be termed as anomaly. The final Minutes on release by the Chairman will be circulated through website shortly.

Meeting with the Health Ministry

A meeting was scheduled by the Health Secretary but due to his absence the Joint Secretary who is in charge of CGHS took the meeting with the JCM National Council Staff Side on 3.3.2010. A further meeting will also take place shortly. NFPE has requested the Confederation to raise the issue of merger of Postal Dispensaries with the CGHS with the Joint Secretary for early approval. We have also requested for hospitalisation treatment for non-CGHS CSMA pensioners in authorised hospitals etc. Highlights of the meeting took by the Joint Secretary on 3.3.2010 was that tenders have been floated for recognizing super specialty hospitals and hospitals for general diseases; the suggestion of staff side for appointing specialist doctors on contract basis until regular appointments stands accepted and orders under issue; Orders issued for approved firms for local purchase of ayurvedic and homeopathic medicines. The Joint Secretary told that the Committee of Secretaries has agreed to allow P&T Pensioners for CGHS dispensaries in CGHS Cities only and that the issue of enhancement of FMA from 100 to 500+DA is forward and the proposal is pending before the Expenditure Secretary. The issue of enhancement of dependency criterion to 1500 is sent to Committee of Secretaries and the same would be expedited. Health check up of over 40 years CGHS beneficiaries started in south zone and the same would be extended soon to Delhi. The Official side declined to include acute renal failure in the disability list and for reducing the exorbitant CGHS rate of subscription. Full details of discussion are available in our website.

Observance of Postal JCA Programme

The Programme of Postal JCA for a demonstration in front of the Parliament had been observed in Delhi. The reports from Circles about the adherence of the programme and sending speed post letters to Hon'ble MOC&IT are yet to come. The culture of sending reports about holding of the programmes called by headquarters is yet to develop among circles and branches. While the communication link from headquarters is maintained well through websites and circulars etc, the channels for sending feedback from below are to be streamlined.

Formation of Casual Labourers Union

As per the decision of the Confederation and Federal Executive of NFPE casual labourers union consisting of all types of casual labourers and contingent workers and daily rated Mazdoors are to be formed in all circles. Only West Bengal and Andhra Circles have formed the unions. Some other circles are on the job and expected to be completed soon. Let us have a target of forming the Casual labourers union in the month of May immediately after completion of the Re-verification process. An All India Union for the Casual labourers is to be founded by the end of May 2010 and the possibilities of holding the first all India conference in West Bengal is under consideration. All Circle Secretaries are requested to take full interest and form the casual labourers union in their respective circles at the earliest.

Subject:- Regulation of journeys by private airlines while availing Leave Travel Concession

The undersigned is directed to refer to Department of Expenditure O.M.No 19024/1/2009-E.IV dated 13/7/2009 and this Department's O.M. No. 31011/2/2006-Esst-(A) dated 27.7.2009 regarding journey by air while availing Leave Travel Concession (LTC), stipulating that in all cases of air travel (including LTC) both domestic and international where the Government of India bears the cost of air passage, the official concerned may travel by Air India only.

2. It is clarified that restriction of travel by Air India only need not apply to non-entitled officers who travel by air and claim LTC reimbursement by entitled class of rail.

3. The above orders will be applicable with effect from the date of issue of this Office Memorandum. Past cases already settled will not be re-opened.

4. This issues in consultation with Ministry of Finance (Department of Expenditure) vide their I.D. No. 19024/1/2009-E.IV dated 9.3.2010.

INDIA TAKES A GIANT LEAP FOR EMPOWERING WOMEN


EMPOWERMENT OF WOMEN – RAJYA SABHA DEBATES AND ADOPTS WOMEN BILL TODAY
BILL FOR 33% Reservation in all elected legislature positions for women placed and debated in Rajya Sabha today - Adopted overwhelmingly by the Government with the support of Opposition Parites like BJP and Left Parties
Some Political Parties opposed the Bill on the grounds of lack of reservation for Dalits and OBCs in the Bill and even attempted to physically obstruct the moving of the Bill instead of allowing the Bill and discussing for improvements and changes democratically by building a consensus
However the Bill was adopted by Voting with a thumpping majority of 191 to 1

HOLD DEMONSTRATIONS AT THE CALL OF THE CONFEDERATION ON 10.03.2010

Confederation of Central Government Employees & Workers has issued a Call for Nationwide Demonstrations on 10.03.2010 Demonstrations are against the 'Introduction of Pension Fund Regulatory and Development Authority Bill' and 'New Tax Code' by the Government in the current Budget Session of Parliament. Demonstration is also against the Price Rise. If the PFRDA Bill is adopted then the future of all Central Government Employees will become unsafe - The Government may subsequently order inclusion of all existing Government Employoees also under the Act and make the Contributory Pension Scheme compulsory for one and all. The total Privatisation of Pension will lead to a disaster of lives of millions of Government Employees. It is time to voice our protest so loudly that the law makers of the Parliament understand our concerns. The New Tax Code is attacking even the lowest paid employees while extending concessions to upper wage earning brackets. We demand re-introduction of Standard Deductions and upward ceiling revision of non-taxable income. The Price rise goes unchecked and whatever cushion we, the CG Employees got due to implementation of 6th CPC recommendations is fastly disappearing. We cannot against such a steep and unprecedented price rise. The current budget proposals of petrol and diesel price hike and increase of Excise Duties will further push up the prices of all essential commodities. Confederation of CG Employees has called upon for a protest demonstration all over India on 10.03.2010 for the above three issues. NFPE & P3 CHQ Calls upon its rank and file Circles / Divisions / Branches to implement the call of the Confederation without fail.

DoP ORDERS FOR NOT TO FORCE SPMs TO OCCUPY STAFF QUARTERS IN POSTAL COLONIES

Department of Posts issued orders today to all Chief PMsG not to force the Sub-Postmasters posted in TSOs to occupy Postal Staff Quarters in Postal Colonies

This issue was taken up by our CHQ and now It has been clearly directed that only in the event of the TSO having a post attached rent free quarters the incumbent is mandatorily accept the quarters and even if the incumbent is unabto occupy rent free quarters, no HRA can be drawn for the officials.

I am directed to intimate that instances have come to the notice of the Directorate that the officials posted as Sub-Postmasters in Town Sub Offices are being forced to occupy the staff quarters in the Postal Colony without actually applying for the same.

2. In this connection instruction/guidelines issued by this Directorate vide letter No.7-6/99-Bldg. (copy enclosed) dated 10/11/07.2000 on the subject mentioned above may kindly be referred to. As per the extant orders no Government accommodation can be thrust upon any Government Employee against his willingness and in the absence of a written request for allotment of a quarter from the employee. However, it is mandatory for the employee to occupy the post attached rent free accommodation wherever available. In such cases no HRA can be drawn in favour of the employee even if he is unable to occupy the rent free quarter.

3. It is, therefore, requested that the instructions/guidelines on the subject may kinldy be followed strictly.

DOPT ISSUED ORDERS ON FIXATION OF PAY UNDER FR-35

Under FR-35 the Government can fix the pay of the Officiating Government Employees at an amount less that admissible under FR.

After the implementation of 6th CPC this has not been done so far and the issue was taken up by the Staff Side also - Now the DOPT has issued orders specifying the Pay to be fixed under FR-35 to different Officials.

Sub: Anomaly in fixation of Pay of promotees and direct recruits – agenda item No.5(iv) of the National Anomaly Committee-regarding

We solicit your kind reference to the minutes of the National Anomaly Committee meeting held on 12th December 2009 under the chairmanship of the Secretary (Personnel)- on the above issue at pages 4 and 5, circulated Vide O.M.No.11/2/2008- JCA dated 5.2.2010. The operative part of discussion, as is incorporated in the last sentence in page 5 reads as under:

"The Chairman suggested the Department of Expenditure to re-exam the matter"

During on discussion , The Joint Secretary(Personnel) had observed that in case where the promotee and post 1.01.2006 direct recruits are borne on the same seniority list and the senior is drawing less basic pay than junior, the pay of senior can be stepped up. This no doubt, only partially remove the anomaly.

As per the above observation the ministry of Railways issued an order, on 17.2.2010 a copy of which is enclosed for your ready reference. In para 2 thereof, it has stated that the said order has been issued in consultation with the Ministry of Finance.

We shall be grateful if similar orders are issued by the Department Expenditure so that the employees similarly placed in other departments could get the benefit thereof, howsoever limited it is.

Subject: Applicability of minimum pay/stepping up of pay clarification reg.
A number of references have been received in this office regarding applicability, for departmental promotees, of minimum entry pay prescribed for direct recruits (appointed on or after 1.1.2006) in Section II of Part A of the First Schedule of RS(RP) Rules, 2008. References have also been received regarding stepping up of pay of senior promotees with references to such of their directly recruited juniors who are recruited on or after 1.1.2006 and whose basic pay is more than that of their seniors.
2. The matter has been examined in consultation with Ministry of Finance. In this connection it is clarified that the revised pay structure comprises grade pays and running pay bands and in the case of those Railway servants who were already in service before 1.1.2006. Sixth Pay Commission has not prescribed a minimum pay in the running pay band with reference to the minimum entry level pay prescribed for direct recruits appointed on or after 1.1.2006. Further, the Sixth CPC has not prescribed minimum pay in the pay band for the purpose of fixation of pay on promotion in the case of any grade and fixing of minimum pay in the pay band in the case of each grade pay for departmental promotees would defeat the very purpose of introduction of running pay bands.
As far as the matter relating to bringing the pay of existing Railway servants as on 1.1.2006 at par with the pay of direct recruits recruited on or after 1.1.2006 is concerned, it is clarified that the pay of those Railway servants who joined the Railway as direct recruits on or after 1.1.2006 is to be fixed as per Section II, Part 'A' of the First Schedule to the RS(RP) Rules, 2008 and the procedure of pay fixation is based on a specific recommendation of the Sixth Pay Commission, which has been accepted by the Government. As far as pay fixation in respect to those Railway servants who were already in service on 1.1.2006 is concerned, the same is to be done as per the provisions of Rule 7 of RS(RP) Rules, 2008 and in accordance with the fitment tables annexed with this Ministry's letter No.PC-VI/2008/I/RSRP/1 dated 11.9.2008.
4. In the light of the foregoing, it is clarified that in terms of RS(RP) Rules,2008:-
(a) no minimum pay in the pay band can be prescribed in the case of promotion of Railway servants from one grade to another (except in the case of change in pay band); and
(b) pay of those Railway servants who were already in service on 1.1.2006 can not be fixed with reference to the minimum entry pay prescribed for those who joined the Railways as direct recruits on or after 1.1.2006 as per Section II, Part 'A' of the First Schedule to the RS(RP) Rules, 2008.
5. However, stepping up of pay of seniors can be permitted with reference to such of their directly recruited juniors borne on the same seniority list who are recruited on or after 1.1.2006 and whose basic pay is more than that of the seniors, subject to the following conditions:-
(a) Stepping up of the basic pay of seniors can be claimed only in the case of those cadres which have an element of direct recruitment and in cases where a directly recruited junior is actually drawing more basic pay than the seniors. In such cases, the basic pay of the seniors will be stepped up with reference to the basic pay of the juniors. Stepping up will be applicable from the date junior direct recruit is actually drawing higher basic pay than the senior.
(b) Further, Railway servants cannot claim stepping up of their revised basic pay with reference to entry pay in the revised pay structure for direct recruits appointed on or after 1.1.2006 as laid down in Section II of Part A or First Schedule to the RS(RP) Rules, 2008, if their cadre does not have an element of direct recruitment, or in cases where no junior is drawing basic pay higher than them.
(c) Stepping up of pay of the seniors shall not be applicable in cases where pay of direct recruits has been fixed at a higher stage on account of grant of advance increments etc. at the time of recruitment.

8th FEDERAL COUNCIL OF NFPE

8th FEDERAL COUNCIL OF NATIONAL FEDERATION OF POSTAL EMPLOYEES WILL BE HELD IN NEW DELHI FROM 20th JUNE TO 22nd JUNE 2010

NFPE Federal Secretariat meeting held on 3.3.2010 has decided to hold the next session of Federal Council of NFPE in the Capital City

The venue of the Federal Council will be the Muktadhara Auditorium [Benga Sanskriti Bhavan] in Gole Market Area, New Delhi - 110001

Stay accommodation to the Federal Councillors and Observers to the Federal Council is arranged in Chug Dharmshala at a walkable distance from the venue of Council.

Trade Union leaders of Central Trade Unions and Leaders of JCM Staff Side, Confederation of CG Employees, Central and State Government Employees leaders would be invited to address the inaugural session of the Federal Council on 20th June 2010

Federal Secretariat considered the possibility of holding the Federal Council elsewhere by some Circles but due to time constraint and other factors decided to hold it New Delhi directly by the Headquarters of the Federation. The Federal Secretariat decided to appeal to all Circle Unions and Divisional / Branch Unions to extend total cooperation in holding the Federal Council in a befitting manner through their maximum procurement of Advertisement to the Souvenir published at the time of Federal Council Session. Advertisement Tariff will be despatched to all Circles shortly and our Circle Secretaries and Divisinal and Branch Secretaries are requested to play their due role. It is the solidarity and cooperation of all rank and file leadership that the Federal Council can be held successfully.

Direct contributions from Branches / Divisions towards NFPE 8th Federal Council also is appealed for by the Federal Secretariat.

Federal Council Session of NFPE is always a historic occaassion in our long and historic movement. It is the Federal Council Sessions that have always given direction for our movement in the best interests of Postal Workers. The 8th Federal Council also is expected to play a dominant role in shaping the policy direction of our movement for the future.

LET US ALL JOIN HANDS TO MAKE THE 8TH FEDERAL COUNCIL A HISTORIC AND SUCCESSFUL SESSION.
