Sub: Request to rein in the misdeeds and misdemeanor of the Officiating SPOs of Tirupattur Division in Tamil Nadu Circle – reg.

This union is constrained to bring to your notice about the atrocities unleashed by the present officiating SPOs of Tirupattur Division with a request to rein in his misdeeds and misdemeanors.

At the outset, it is brought to our notice that Sri K. Kumar who is presently officiating in the vacant post of SPOs was formerly ASPOs in the same division. Further, he was serving in the division in various capacities for more than 20 years thus paving way for formation of a closely knit coterie to meet his own requirements fulfilling his ulterior motives. He is continuing in the officiating arrangement through four extensions of such arrangements provided to him.

To quote a few of his long list of misdeeds, this union lists below certain instances that affected the officials severely.
Issuance of DIES-NON for spells of medical leave availed by some officials as noted below:

The officiating SP is in the habit of sanctioning leave according to his own whims and fancies. As the leave sanctioning authority, he never refused leave to the above noted officials as mentioned in para supra who produced MC nor sent them for second medical opinion. Instead, he adopted the measure of wage cut without adhering to any rule on the subject.
Likewise, in granting leave for officials also two different yardsticks are being followed. While many requests are bluntly turned down or restricted, some others get liberal treatment for the reasons best known only to him.

Even for lapses in submission of statements/reports to D.O. owing to acute shortage of staff the officials would be harassed over phone directly by the officiating SP. He even went up to the extent of threatening them with dire consequences. This has resulted in enormous load of mental agony and depression amongst a majority of the employees.

The harassment of employees reaches a peak when it comes to reaching the target of RPLI by the GDS employees. Without motivating the officials to reach the fixed target, he used to hurl verbal abuses and threats in the MELAS that result in total negative impact as the employees are demoralized and de-motivated resulting in the slump of performance. This is a deviation from the past when the previous incumbents used to motivate employees to reach the targets.

The inordinate delay caused deliberately by the officiating SP in releasing 60% arrears to the GDS employees despite the fact that the rolls were made ready to delay the payment by atleast 10 days caused heartburns amongst them who were totally agitated.

When such various misdeeds are exposed by the divisional unions through handbills as per the convention, the officiating SPOs got infuriated and as an act of vengeance he proceeded against the divisional secretary of our P3 Divisional union. The charge-sheet was replied but the divisional Secretary was awarded with a CENSURE. This again proves that he is intolerant towards legitimate trade union activities. It is further added that the other unions like FNPO are also agitating against him because of his anti-worker attitude. The SC & ST Welfare Assn. has also issued a bulletin strongly criticizing him. These are examples of his anti trade union attitude.

Finally, to cap all his misdeeds, he chose to victimize our divisional secretary Sri. V. Subramanian through an unwarranted transfer order during this RT. The official who is due for RT has opted for 3 offices as called for. He is sufficiently senior also. But the officiating SP chose to post him to a far-off place from the HQ which is not opted by him, denying him the right of immunity, with a vindictive attitude without any valid reasons knowing pretty well the constitution of this union to prevent our divisional Secretary from functioning as the duly elected union representative by transferring him to an office coming under Gudiyatham branch. It is crystal clear that the motive of the Officiating SP is to disturb Sri. V. Subramanian from the divisional Secretary Post.

To conclude, this union wishes to state that for the past so many decades, this division remained peaceful with total understanding and coordination between the administration and unions. But the peaceful atmosphere has been fully marred by the present officiating SP who indulges in misdeeds for some ulterior motive. This results in total chaos and loss of industrial peace in the division and a state of restlessness amongst the employees also prevails.
It is therefore requested to kindly intervene and rein in the situation by posting regular SPOs besides causing enquiries about the misdeeds and vindictive attitude of the present officiating SPOs and cancel the vindictive transfer orders issued against the divisional secretary to far off place with the intention to forfeit his position as the divisional secretary of the division.

Since the elected circle union of this union could not assume charge due to the prolonged court cases, it is perforced to bring the following to your kind notice for immediate settlement.

There are several irregular as well as inconvenience transfers orders accorded in the rotational transfer orders and the aggrieved officials have represented to the regional office seeking modification of their transfers.

It is learnt that such representations have been forwarded to your office for consideration. Since transfer is having a vital factor in the settlement of family and imparting education to the children and also for other causes, it is requested to kindly consider the representations sympathetically and cause appropriate orders at the earliest.

Sub: Delay in allotments of circles and imparting training – case of surplus qualified (SC/ST) for the year 2008 in the IPO exam

It is brought to our notice that even though the results of the surplus qualified candidates in the IPO exam held for the year 2008 under the SC/ST category has been released on 18.9.2009 itself, allotment and training orders have not been issued so far.

The candidates have not been permitted to write subsequent examinations since they were declared qualified in the surplus list. Further it is pertinent to mention that the candidates subsequently declared were made allotment of circles. This causes a concern.

It is therefore requested to kindly expedite action for the allotment and according training to the surplus candidates declared for the year 2008 immediately and without any further delay.

The syllabus for the IPO examination has been liberalized and also brought under the objective type questions under the OMR method. During 2007, the Directorate has considered the introduction of surplus qualified and posted to other circles in the unfilled up posts.

There are many candidates exhausted their chances earlier due to circle level competition on merits and they are really deprived the fruits of the new pattern.
It is therefore requested to kindly consider for providing two more chances to the candidates who have exhausted all the chances earlier subject to other conditions like age etc.

Sub: - Attempt to leave the culprit Agent defrauded Lakhs of Money in MIS, RD & SAS Accounts & making the innocents as scapegoats under contributory factors – case of Annaroad HPO in Tamilnadu Circle - request intervention.

It is brought to our notice that one SAS agent Smt. Devasena who is attached to Anna Road PO by obtaining the signatures of the depositors either in closure applications or withdrawal forms has committed frauds to the tune of lakhs of rupees. The case has been handed over to police and she had accepted the guilty and confessed that she had misused the application of withdrawals obtained from the depositors and defrauded the amount. She has been granted bail by the court of law.

The modus operandi, as stated, that she obtained the signatures of the depositors and acted as messenger in most of withdrawals. The administration has not taken any efforts so far to confiscate the property or her belongings in order to recover the defrauded amount from her.

Whereas the present Chief Postmaster, Annaroad HPO is attempting to fix responsibilities on almost all PAS working in SB branch of Annaroad HO on one pretext or the other in order to recover the amount under contributory factors by citing minor lapses or the mistakes left unnoticed which come under the extenuating factors.

There was no violation of rules and there was no difference in the signature available in the SB 3 and the Agent was acted as Messenger in most of the cases which is permitted as per the rules. However all the PAs and Supervisors have been tortured in recent days.

This is nothing but excessive and to protect the interest of the culprit. Instead of pursuing the case vigorously with the police authorities for early prosecution of the guilty and with the revenue authorities to recover the loss sustained to the department, the Chief Postmaster, Anna road is causing arbitrary and unwarranted actions against the innocents which causes a serious concern.

It is pertinent to mention that the present action initiated to recover the loss sustained to the department from the innocents is against to the provisions of Rule 106, 107 & 108 of Volume III and Rule 204 A 91) of Volume III which stipulates that honest errors shall be condoned. This has further been discussed elaborately in FHB Vol I Appendix 4.

The Directorate vide its Memo no 6/8/59 – Disc dated 9.7.1959 while discussing about the recovery under contributory negligence stated interalia;

“It is of equal importance that the concept of contributory negligence should be correctly understood by the Disciplinary authorities and there should not be any attempt to somehow or other effect recovery of the entire loss sustained by the department by imposing punishments on official who are guilty of only minor omissions. It should be correctly assessed in a realistic manner and while determining any omissions or lapses on the part of the official, the bearing of such lapses on the loss considered and the extenuating circumstances in which the duties were performed shall be given due weight.”

In the case of Anna road HPo which is one of the busiest counter offices in Chennai under the nose of Circle office is performing the double the duties by each counter PAs which can be verified at any time. Instead of finding the officials responsible for their failure to take immediate follow up action to recover the amount from the guilty by moving state authorities or by confiscating the properties and belongings, the administration is now resorting to cause action to recover the entire the amount from the innocent officials under one pretext or the other. This causes a serious concern.

While discussing the charter of demands on 6.7.2011, the Secretary has agreed to our views on the issue of contributory negligence and arbitrary recovery and based on the discussions, the Directorate, vide its letter no.14013/03/2010 – VP dated 22.06.2011 has clarified the factors recently.

Under these circumstances, it is requested to kindly intervene and cause appropriate instructions to the concerned to drop the charges and initiate action to recover the loss sustained to the department from the culprit who admitted the fraud before the police itself.

Sub: - Arbitrary & unjust deputation of selected PAs to Chennai City South division – case of Chennai GPO

It is brought to our notice that the eight postal assistants recruited in the last batch for Chennai GPO have been ordered to join in Chennai south division after completion of training on deputation basis which causes the shortage problem at Chennai GPO as static.

According to establishment figure of Chennai GPO as on 1.10.2010, only 167 PAs are working out of the sanctioned establishment strength of 246 PAs. Similarly out of 30 LSG posts, only six officials are posted and the remaining shortage is being managed from the strength of 167 PAs. Five officials are officiating in higher HSG II & HSG I posts. Resultantly, almost all the branches are overloaded and the officials are being looking after the duties of two PAs. There was a ray of hope in getting relief from over burden after the recruitment and that has been shattered due to the deputation of newly recruited PAs to Chennai City South division.

The staff are very much aggrieved and agitated due to unbearable work load in many branches and doing double duties every day without any compensation.

It is therefore requested to kindly reconsider the decision and return back all the deputationists to Chennai GPO and arrange relief to the toiling Postal assistants.

SUB: Non grant of due LSG promotion to one Sri. R.Sabayanagam, PA, Neyveli-2 in Cuddalore Dn – Reg.

It is brought to our notice that the said official was due for LSG promotion during the year 2010, but he was not awarded with the said promotion during. When he preferred appeal, it was replied that he has not been accorded LSG promotion as he did not possess three Good bench marks during the last five years in his CR/APAR which is the basic requirement for norm based promotions.

But in his case, while processing his MACP III , review DPC has upgraded his adverse and average entries for the years 2005 to 2010 as ‘good’ except for the year 2007-08, as ‘average’ and the same was approved by the DPS, Trichy vide his memo.no. STC/89-Misc.1/RS/2011 dated 02.05.2011. Based on the upgradation of CR entries, he was awarded with MACP III with retrospective effect from 7.4.2009.

Accordingly, after the upgradation of his CR entries, he is entitled for regular promotion to LSG for which a review DPC has to be constituted for consideration of his case.

It is therefore requested to kindly accord necessary action for constitution of review DPC in his case and cause orders retrospectively in order to protect his seniority in LSG cadre.

Sub: Fabricated & concocted cases foisted on Union rivalries – case of Thanjavur division

It is constrained to bring to your kind notice that there is a prolonged organizational dispute in the case of Divisional Union in Thanjavur Division,due to election disputes and filing of court cases one after another at Honble High Court, Madurai, Civil Court and Sub-ordinate Courts at Thanjavur etc and the adhoc committee constituted to conduct fresh election of office bearers could not complete its task due to court cases. As such, this is the glaring truth that there is in depth rivalry prevailing between the two groups within this union . The two groups are being led by Sri M.Ramanathan and Sri R.Asaithambi since both were claimed as divisional secretaries whom the CHQ has not approved and ordered for fresh election.

While fresh elections were notified by the Adhoc Committee headed by Sri. Selvakumar, there also further dispute was raised by the one of the group headed by Sri. R.Asaithambi, ME, Thanjavur HO and a fresh court case was also filed by him at Thanjavur.

Resultantly, the election notified on 3.4.2011 was also postponed by the adhoc committee and on the same day Sri R.Asaithambi invited all to conduct a parallel conference but which he could not materialize due to court orders.

Subsequently after two days when Sri.M. Ramanathan enquired about the efforts to conduct another conference on 3.4.2011 by Sri R.Asaithambi and their assistance to him for the defunct of the divisional union to some lady members, this was twisted by the opposite group and complaint was obtained from them against him under sexual harassment as if he uttered some filthy words against them. The signature campaign was conducted by the rival group openly among the women employees and many of them have signed without knowing the consequences and effect against the said sri M.Ramanathan.

Based on the complaint, he was placed under suspension w.e.f. 18.4.2011 and enquiry is pending. But the persons who raised such complaint under the instigation have now felt much on. The complaint has been made purely as an act of vendetta to settle score with the said official with the connivance of the some of the officers of the divisional administration. He is due for his superannuation within ten months and the prolonged suspension will mar his morale and cause loss to him. This is a clear case of union rivalry and the records available in the divisional office, Thanjavur will exhibit that how much of false and fabricated complaints were made during this two years against him. One should not be victim due to inner rivalries and innocence should be protected.

It is therefore requested that his case may kindly be reviewed on the stated grounds and he may kindly be re-instated and even ordered to be posted in any other office within Thanjavur limit , other than Thanjavur HO, till finalization of the enquiry and render justice and fair play. The official has represented to higher ups seeking justice and fair play in his case
