A DELEGATION OF NFPE MET TODAY OUR MEMBER [P] AND DISCUSSED SOME IMPORTANT ISSUES

We brought to the notice of the Member [P] that while in all circles the orders of the DoP has been implemented by relieving the AAO Promotees as per the list placed in the DoT website, the Circle Administration of Tamilnadu is not doing so but seeking clarifications from Directorate. We urged for immediate relief to the AAO Promottes of Tamilnadu Circle. We also met the DDG PAF and informed our interaction with the Member [P] and also urged for similar action to relieve all the AAO Promotees to maintain uniformity in all circles. The letter submitted by the NFPE in this regard is available at the bottom of this blog. We also pointed out through our letter and discussion that in blatant violation of status quo agreed upon by the Department on RMS on 1st December 2009, the General Line HSG-I posts in Mail Offices are being filled up by the ASPOs on the basis of the Minutes of the official side work shop held at Bangalore. We requested that the measure is violative of statutory rules on the subject. This letter also is available at the bottom of this blog. We raised the issue of down gradation of GDS SOs into GDS BOs that may result in down gradation of the status of the HPOs also in addition to the economic loss to the GDS SPM incumbents despite any protection of pay for the time being. We urged for reconsideration of the stand. The letter in this regard is also placed at the bottom. The undue delay being caused on grant of revised wages to casual labourers, contingent workers and GDS Substitutes also was raised and we sought the intervention of the Member [P] for immediate stand at the level of the Directorate level itself instead of taking the matter to DOPT which is unnecessary. We will follow up the issues and as soon as any development is notices the same would be communicated by us.

Sub: Relieving AAO Promotees from Tamilnadu Circle to ensure uniformity all over India – reg.

Ref: Directorate Orders No.301(12)2010/PA Admn III/567-633 Dated 28.01.2010

Kindly refer to the DoP Order cited above endorsing the orders of DoT Dated 23/12/2009 and 13/01/2010 on the question of promotion to AAO promotees. Based on the above orders of the Postal Directorate, several Postal Circles have already relieved the AAO Promotees as per the list published in the website of DoT. Unfortunately, the Circle Administration of Tamilnadu Circle instead of relieving the AAO Promotees and directing them to present themselves before the Controller of Accounts in DoT Circle Offices as was correctly done in other Postal Circles, reportedly delaying the relief in the name of seeking clarifications from Postal Directorate and raising the issue of staff shortage etc. The issue of staff shortage was already discussed at the highest level of the Department by this Federation wherein the Secretary Department of Posts had categorically informed that shortage is not a problem anymore in the background of winding up of Screening Committee. The delay in relief to the Promotees in Tamilnadu Circle will only delay the three months training to be imparted to them while several of their juniors in other circles might complete the training in advance. This Federation urges for uniformity in all Circles in implementing the orders of the DoP on this important issue involving promotion to a good number of officials and requests for issue of appropriate instructions to Tamilnadu Circle Administration for causing immediate relief to all those AAO promotees who have submitted their declarations. An early action in this matter will receive our high appreciation.

Sub: Violation of Statutory Rules of Promotion and Posting in HSG-I Posts in RMS without proper orders and procedures – regarding.

Ref: Minutes of the Official Side Work Shop conducted by the Department at Bangalore.

Madam,

This Federation is shocked to find that the Circle Administration in several Circles are going ahead in replacing the HSG-I incumbents earmarked for promotion to General Line Officials in Mail Offices by IPO Line Officials. We wish to point out that the move has no backing of any statutory provisions of the Department. Unless and until the issue is discussed with the staff side and until the rulings on the subject of promotions to HSG-I to General Line officials exist in its present form, such unilateral posting of IPO line officials against General Line vacancies are unjust and unconstitutional. A new culture is being introduced by such unconstitutional methods in the Department of Posts wherein the Administration is usurping the powers to nullify the provisions of the Statutory Rulings. We wish to refer to the joint letter given by the NFPE and FNPO Federations on 31.01.2010 expressing the view points on the Action Points mentioned in the minutes of the Bangalore Workshop of Official Side. There are several issues on which the opinion of the Department is retrograde and unilateral. This Federation protests strongly the action of the Administration in implementing such serious issues in contravention of Departmental Rulings just in the name of a official side work shop. We therefore urge upon you to cause immediate instructions to stall any such unilateral moves and order maintenance e of status quo in the status of the HSG-I Posts in the RMS Wing. An early action in this matter will be appreciated very much by this Federation.

POSTAL JCA DECISIONS - NEWS HIGHLIGHTS

All India Postal Joint Council of Action comprising of NFPE - FNPO Federations and their Affiliated Unions and GDS Unions has met today in the office of the FNPO in New Delhi.

Postal JCA analysed the following serious issues emerging before the Postal Employees and considered that the situation if not remedied would lead to an ultimate Strike Action and therefore a serious and immediate All India Action in the shape of a Massive Protest Demonstrations before the Parliament during the ensuing Budget Session on 2.3.2010 should be jointly organised with all vigour and commitment.

The Postal JCA would write letters to Honourable MOC & IT; MOSC & IT; Cabinet Secretary; DOPT Secretary and also the Secretary DoP on the serious issues emerged before as follows:

1. GDS Issues: Down gradation of GDS SOs into GDS BOs; Unilateral introduction of Cash Handling Work Norms for BPMs and the rejection by the Department to modify the same causing huge financial loss to BPMs; Denial of correct Prorata wages to GDS; Disparity in PLB to GDS; and Non-Revival of GDS Departmental Committee similar to the earlier ED Departmental Committee for negotiating all issues of GDS with the Department.

2. Casual Labourers Issue: The Department is unduly delaying orders on revision of wages to Full Time and Part Time Casual Labourers; Contingent workers and GDS Substitutes instead of following the statutory rulings on this issue.

3. Violation of Status Quo Agreement on RMS & MMS: There is a recent agreement through the official minutes supplied by the Department on the meetings held between the Secretary, Member [O] and the Staff Side 1.12.2009 accepting that the status quo situation on RMS & MMS would be ensured as on that day until the issue is discussed with the Staff Side by the Mail Consultancy. Contrary to this written assuranace, the Department in the name of some Official Work Shop conducted in Bangalore going ahead with disturbing the status quo including snatching the HSG-I Posts of General Line and handing over to ASPOs without amending any statutory Rulings on the issue.
4. Postmasters Cadre Creation: In spite of the stiff opposition from the Staff Side the Department has issued orders for creation of Postmasters Cadre from LSG to Group B -- The existing supervisory officials will be given one time option to get into the Postmasters Cadre or remain in the Non-Postmasters Cadre - All future vacancies of LSG Postmasters will be only through Competitive Examination and there would be no more seniority-cum-fitness promotion into the Postmasters Cadre.

5. General Attitude of DoP: The general attitude of the Department of Posts has become one of ignoring the Staff Side before taking any important decisions affecting the interest of the Postal Employees and the Services. Similarly no agreement signed or agreed upon with the STaff Side are being faithfully implemented. With this type of attitude the interests of entirety of Postal Employees is at stake.

POSTAL JCA DECISIONS:

1. Submitting detailed letters to Honourable MOC & IT; MOSC & IT; Cabinet Secretary; DOPT Secretary; & Secretary [P].

2. Holding Massive Protest Demonstration before the Parliament on 2.3.2010 during the ensuing Budget session of parliament - Inviting Honourable Members of Parliament seeking their intervention - Holding Protest Demonstrations all over the country on the same day and sending of the copy of the All India Letter to Honourable MOC&IT through Speed Post by all Branches and Divisions and Circles jointly.

3. Take a decision for Strike that should be decided by the next Postal JCA meeting if the above exercises turned futile.

4. A Detailed Circular by the Postal JCA would be released shortly.

Subject: Posting of husband and wife at the same station.

In view of the utmost importance attached to the enhancement of women's status in all walks of life and to enable them to lead a normal family life as also to ensure the education and welfare of the ·children, guidelines were issued by DOP&T in O.M No. 28034/7/86-Estt.(A) dated 3.4.86 and No.28034/2/97-Estt.(A) dated 12.6.97 for posting of husband and wife who are in Government service, at the same station. Department had on 23.8.2004 issued instructions to all Mins.lDeptts. to follow the above guidelines in letter and spirit.

2. In the context of the need to make concerted efforts to increase representation of women in Central Government jobs, these guidelines have been reviewed to see whether the instructions could be made mandatory. It has been decided that when both spouses are in same Central Service or working in same Deptt. and if posts are available, they may mandatorily be posted at the same station. It is also necessary to make the provisions at Paras 3(iv) and (vi) of the a.M. dated 3.4.86 stronger as it is not always necessary that the service to which the spouse with longer service belongs has adequate number of posts and posting to the nearest station by either of the Department may become necessary.

3. On the basis of the 6th CPC Report, Govt. servants have already been allowed the facility of Child Care Leave which is admissible till the children attain 18 years of age. On similar lines, provisions of a.M. dated 12.6.97 have been amended.

4. The onsolidated guidelines will now be as follows:(i) Where the spouses belong to the same All India Service or two of the All India Services, namely lAS, IPS and Indian Forest Service (Group 'A'); The spouse may be transferred to the same cadre by providing for a cadre transfer of one spouse to the Cadre of the other spouse, on the request of the member of service subject to the member of service not being posted under this process to his/her home cadre. Postings within the Cadre will, of course, fall within the purview of the State Govt.(ii) Where one spouse belongs to one of the All India Services and the other spouse belongs' to one of the Central Services:- The cadre controlling authority of the Central Service may post the officer to the station or if there is no post in that station, to the State where the other spouse belonging to the All India service is posted.(iii) Where the spouses belong to the same Central Service:The Cadre controlling authority may post the spouses to the same station. (iv) Where the spouse belongs to one Central Service and the other spouse belongs to another Central Service:- The spouse with the longer service at a station may apply to his/her appropriate cadre controlling authority and the said authority may post the said officer to the station or if there is no post in that station to the nearest station where the post exists. In case that authority, after consideration of the request, is not in a position to accede to the request, on the basis of non-availability of vacant post, the spouse with lesser service may apply to the appropriate cadre authority accordingly, and that authority will consider such requests for posting the said officer to the station or if there is no post in that station to the nearest station where the post exists.(v) Where one spouse belongs to an All India Service and the other spouse belongs to a Public Sector Undertaking:The spouse employed under the Public Sector Undertaking may apply to the competent authority and said authority may post the said officer to the station, or if there is no post under the PSU in that station, to the State where the other spouse is posted.(vi) Where one spouse belongs to a Central Service and the other spouse belongs to a PSU:- The spouse employed under the PSU 'may apply to the competent authority and the said authority may post the officer to the station or if there is no post under the PSU in that station, to the station nearest to the station where the other spouse is posted. If, however, the request cannot be granted because the PSU has no post in the said station, then the spouse belonging to the Central Service may apply to the appropriate cadre controlling authority and the said authority may post the said officer to the station or if there is no post in that station, to the station nearest to the station where the spouse employed under PSU is posted.(vii) Where one spouse is employed under the Central Govt. and the other spouse is employed under the state Govt.:-The spouse employed under the Central Govt. may apply to the competent authority and the competent authority may post the said officer to the station or if there is no post in that station to the State where the other spouse is posted.(viii) "The husband & wife, if working in the same Department and if the required level of post is available, should invariably be posted together in order to enable them to lead a normal family life and look after the welfare of their children especially till the children attain 18 years of age. This will not apply on appointment under the central Staffing Scheme. Where only wife is a Govt. servant, the above concessions would be applicable to the Govt. servant.

5. Complaints are sometimes received that even if posts are available in the station of posting of the spouse, the administrative authorities do not accommodate the employees citing administrative reasons. In all such cases, the cadre controlling authority should strive to post the employee at the station of the spouse and in case of inability to do so, specific reasons, therefor, may be communicated to the employee.

6. Although, normal channels of representations/complaints redressal mechanism exist in the Min.lDeptts., added safeguards to prevent noncompliance may be provided by ensuring that the complaints against nonadherence to the instructions are be decided by the authorities at least one level above the authorities which took the original decision when they are below the level of secretary to the Govt. of India/Head of the PSU concerned and all such representations are considered and disposed off in time bound manner.

Department of Posts endorses DOT OMs on AAO Promotion

DOT OMs Dated 21.12.2009 & 13.01.2010 on Provisional Offer of Appointment as AAOs have been endorsed by the Postal Directorate today.

NFPE Delegation consisting of Comrade K.V.Sridharan GS P3; Giriraj Singh GS R3; and P.Rajanayagam GS Postal Accounts met Officers in Postal Directorate and urged for early relief of all AAO Promotees.

List of 385 Officials who were offered AAO Promotion as published in the DOT web site is formally thus forwarded to all the Circle Heads for necesasry further action.

NFPE is hearing complaints that some Circles are taking stand not in commensurate with these orders of the DoP and DoT in violation of the Gazette Notification and Ministry and DoT and DoP directives. This will be taken by the NFPE / CHQ for remedial action.

NFPE / CHQ will also appeal for inclusion of IPOs / ASPOs who were desiring to accept the AAO Promotion once again with the Secretary Department of Posts.

RE-GRADING OF ACR BY DPC - AN IMPORTANT ORDER BY DOPT

OFFICE MEMORANDUM

Subject:- Effect on modification/expunction of adverse remarks in the ACRs and upgradationldown-gradation of the overall grading in the ACRs prior to the period 2008-2009.

The undersigned is directed to say that instructions were issued vide O.M. of even number dated 14th May, 2009 by which the complete APAR (previously known as ACR) including the overall grading and assessment of integrity shall be communicated to the concerned officer for representation if any, with effect from the reporting period 2008-09 which was to be initiated from 1.4.2008. Prior to that only adverse remarks in the ACR were required to be communicated for representation, if any. The then existing instructions further provided that the overall grading in the ACR should remain unchanged even after modification or expunction of the entire adverse remarks. It was left to the DPC to re-determine the overall grading if it considered that the expunction of such adverse remarks had so altered the quality of the ACR. The matter has been further considered and it has been decided that in those cases where the reckonable ACRs prior to the reporting period 2008-09 are to be considered in a future DPC on which the adverse remarks of Reporting I Reviewing / Accepting Authorities have been expunged or modified by the Competent Authority, the "overall grading" in the ACR be kept blank for appropriate re-grading by the DPCs. The existing grading shall be blocked in such cases. It has also been decided that where the authority has upgraded / downgraded the overall grading without giving sufficient reasons, the DPC shall treat such an exercise as non-est/ invalid. General terms, such as "I agree or disagree with the Reporting Officer /Reviewing Officer" used by the Reviewing I Accepting Authority shall not be construed as sufficient reason for upgrading / downgrading the overall grading given by the Reporting Authority / Reviewing Authority. The proposals for the DPC where ACRs upto the reporting period 2007-08 will be taken into account should specifically bring out these guidelines.

2. It is also made clear that past cases already decided will not be re-opened.

MEETING WITH CIRCLE ADMINISTRATION

Today, on 04.01.2010 the Circle Secretary Com. J.Ramamurthy, Asst. Circle Secretary Com. V.Venkataraman and Circle Treasurer Com. A.Veeramani accompanied with our General Secretary Com. K.V.Sreedharan met DPS (HQ) and discussed several cases.The highlights are furnished here under:

• In respect of LSG-promotion, the two Members of DPC has cleared the CRs of 536 officials for promotion to LSG and one member of the DPC has to clear the CRs.on finalising the cases by all the Members of DPC the promotional orders will be released before the end of this month.

• The orders issued by CCR for local arrangements in vacant HSG II/HSG I posts by BCR officials terminating adhoc promotion is only to man the stop gap arrangements. However these orders were issued only by Circle Administration.

• Pending finalization of seniority on LSG with FTP officials, the HSG II Promotion is now delayed. However this will be released by the first week of Feb 2010.

• Orders were issued by C.O to form the DPC for MACP promotion headed by Group A with members in the cadre of Group B. Hence the DPC for MACP will be formed soon at ground level now.

Expected Dearness Allowance for Central Government Employees from Jan-2010 is 35%

Expectations arise for rise in DA(Dearness Allowance) to 8% for Central Government Employees Calculation based on All India Consumer Price Index Number for Industrial Workers (CPI-IW) on base 2001=100 For all the Central Government Employees there would be a rise in DA (Dearness Allowance) to 8%,which would result in the overall rise to 35% from 1.1.2010.

To day, the 9.11.2009 Com. K.Ragavendran Secretary General NFPE,

Com. K.V.Sreedharan, General Secretary All India Postal Employees Union, Com.A.Veeramani, Circle Treasurer, Com.N.Gopalakrishnan, Asst. Circle Secretary, Com.V.Venkataraman, Asst. Circle Secretary and Com. G.Manoharan, Ex. Member Adhoc Committee met with Chief Postmaster General Tamilnadu Circle. Particularly the MACP order and its implementation was discussed primarily. The CPMG elaborated the efforts taken and informed that Directorate had been addressed in connection with formation of screening committee.

Further, the high handled approach of Superintendent Karur division was also discussed and CPMG assured for effective intervention.

With regard to HSG II postings it was informed that as required a report has been sent to Directorate and the same is under process. It was further intimated that LSG postings the list is being finalized and will be released shortly for nearly 150 officials.

Dear Comrades / Colleagues,

The Postal JCA of NFPE – FNPO – AIPEDEU – NUGDS has met in the Office of NFPE on 28.10.2009 and reviewed the situation as a follow up to the implementation of GDS Committee and pending issues of Postal Regular Employees. It has been decided that the Postal JCA will again meet in December 2009 after the finalisation of demands by GDS Unions and other Unions for reviewing the situation.

However, the Postal JCA with grave concern reviewed the intensifying attack on the RMS & MMS and the new schemes and plans aimed at liquidating the RMS & MMS completely.

The JCA has thereafter came to the unanimous conclusion that unless the moves are resisted with all our might immediately the Department will go ahead with its negative moves of merger of RMS Divisions; Merger of SROS with HPOs; Merger / Abolition of RMS Offices in violation of agreement between the Directorate and Staff Side; Outsourcing of MMS functions to Private Contractors etc.

It was therefore decided upon to launch an All India Programme of Action under the banner of the Postal Joint Council of Action in November 2009 culminating in an Indefinite Strike action by RMS & MMS Unions of NFPE and FNPO from 15th December 2009.

The Postal JCA letter addressed to the Secretary Department of Posts along with the 10 Charter of Demands and the Programme of Action are enclosed. Circle Secretaries are requested to circulate all by translating in respective Regional languages.

A Strike Campaign Tour Programme by the General Secretaries and the Secretary General of NFPE and FNPO is also under preparation to touch all State Capitals. The Strike Tour will be exhibited in the websites of the Federations shortly.

Let us understand that time has come to rise as one man to defend our existence. Organise most effectively.Organise for our survival.Initiate all round action for the success of the Programme of Action.

Madam,

The Postal Joint Council of Action comprising of National Federation of Postal Employees; Federation of National Postal Organisations; All India Postal Extra Departmental Employees Union; and National Union of Gramin Dak Sewaks held its meeting on 28.10.2009 in New Delhi and unanimously resolved to address this letter to you drawing your kind attention to the growing serious attacks on the very existence of the RMS & MMS under your Chairmanship. The Postal JCA also noted with grave concern that the solemn agreement reached after hectic negotiations between the Department and the Staff Side on the matter of merger of 101 RMS Offices with all men and materials identified with less than 10,000 mail volumes with the neighbouring RMS Offices is being breached in the Second Phase of Mail Consolidation.

Circle Administration here and there have started to attack the existence of RMS Offices with more volume of work in a blatant violation of the agreement reached at the All India level making mockery of such bilateral agreements.

The constitution of a Committee headed by the PMG Kurnool without the knowledge of Staff Side and the recommendations of that Committee to merge all SROs with the HPOs and carry on the functions under the control of the Head Postmasters is a rude shock to the RMS & MMS Employees.

It is afraid that such type of sweeping recommendations of the above Committee without any kind of mutual discussions with the staff side will be implemented unilaterally resulting in the liquidation of RMS and that already another Enlarged Committee with Circles level Officers has been formed for supervising the implementation of the recommendations.

Already 5 ROs out of a total of 14 ROs in the country have been abolished and the balance ROs are also in the process of being liquidated.124 Transit Sections including TMPs have been abolished and mails diverted to road conveyance causing delay in public mails.

There are actions initiated to reduce the number of CRCs in several Metros at the command of the Secretary Department of Posts. There has been no purposeful effort to consider the long pending demand of the Staff Side to finalise the work norms in CRCs and other branches in a scientific manner to do away with the unilateral fixing up of CRC norms. However action has been initiated to close down the CRCs! MMS has been operated by the Department for the speedy and punctual mail conveyance all these years but the policy has been reversed to outsource more and more of the mail conveyance. MMS is being replaced by CMS denoting the handing over of mail conveyance to private players as against the stiff opposition of the staff side.

With the focus shifting from letter mail to logistics more and more universally, and that the Department of Posts also had entered into the logistics services, the future is for a bigger logistics operation in India due to its expanding market of logistics.

In such a scenario instead of planning to build our own fleet of bigger logistics vans and staff, the outsourcing of mail, speed post and logistics conveyance to private contractors is a totally negative approach aimed at liquidation of the MMS wing.



To cap it all the Department has started to merge RMS Divisions in some circles also and the Staff Side is apprehensive that the cumulative effect of all the attacking posture is aimed at total liquidation of RMS and MMS and merge the entire RMS operations with Post Offices and hand over whole MMS operations to CMS.

The necessary intervention needed on the part of the Department of Posts at the Government level for ensuring upward revision OTA Rates which is far low in comparison to casual labour wages and for revising the OSA is absent. Even the re-fixing the ceiling limit for OT entitlement is not done despite staff side representations.

There have been no attempt to get the posts of Drivers and Mail Guards / MSEs filled up despite staff shortage. This shows the Department of Posts is only interested in attacking the interests of RMS & MMS and ignores the interests of staff. The Postal Joint Council of Action after a threadbare discussion has come to the conclusion to address immediately to you seeking your personal intervention for effecting a complete reversal of the policy of liquidation of RMS & MMS and initiate measures to strengthen the RMS & MMS wing through constructive policy directions. The Postal Joint Council of Action has also been forced to take a unanimous decision to launch an all India Programme of Action by the entirety of Postal Employees under the banner of the Postal JCA immediately in the month of November 2009 that will culminate in an Indefinite Strike Action by all RMS and MMS Employees belonging to NFPE and FNPO organisations in December 2009 for which Notice would be submitted at the appropriate time.

The Postal JCA also expresses its hope that there will be change of course by the Department of Posts and that meaningful dialogue with both our Federations and the All India Unions affiliated with us would be preferred on the enclosed Charter of Demands to maintain tranquillity and peace in the India Post.

Fixation of pay in case of employees who seek transfer to a lower post under FR 15(a)

The undersigned is directed to refer to instructions issued vide this Department's OM NO. 16/6/2001-Estt(Pay-I) dated 14.2.2006 on the above subject. It was clarified therein that on transfer to the lower post/scale under FR 15(a), the pay of a Government servant holding a post on regular basis will be fixed at a stage equal to the pay drawn by him in the higher grade. If no such stage is available, the pay will be fixed at the stage next below the pay
drawn by him in the higher post and the difference may be granted as personal pay to be
absorbed in future increments. If the maximum of the pay scale of the lower post is less than
the pay drawn by him in the higher post, his pay may be restricted to the maximum under
FR 22(a)(a)(3).

Consequent upon implementation of the revised pay structure comprising grade pays
and running Pay Bands, w.e.f. 1.1.2006 in cases of appointment of Government servants to
posts carrying lower Grade Pay under FR 15(a) on their own request, the pay in the pay
band of the Government servant will be fixed at a stage equal to the pay in the pay band
drawn by him prior to his appointment against the lower post. However, he will be granted
grade pay of lower post. Further, in all cases, he will continue to draw his increments based
on his pay in the pay band +grade pay (lower).

POSTAL JCA OF NFPE – FNPO – AIPEDEU – NUGDS SHOULD DISCUSS ALL ISSUES ON 28.10.2009 AND PROPER DEMANDS FOR MODIFICATIONS SHOULD BE FINALISED FOR SETTLEMENT - UNITY AND UNITED APPROACH BY ALL UNDER THE BANNER OF POSTAL JCA IS THE ONLY CORRECT COURSE FOR IMPROVEMENT.

THE FOLLOWING ARE NOT EXHAUSTIVE BUT IMPORTANT FACTORS. IN THE VIEW POINT OF NFPE & P3 CHQ THE FOLLOWING ISSUES REQUIRE TOTAL CONCENTRATION FOR MODIFICATIONS BUT THE POSTAL JCA HAS TO TAKE A FINAL VIEW. RANK AND FILE IS REQUESTED TO STUDY THE WHOLE GOVERNMENT ORDERS AND OUR UNDERMENTIONED POINTS AND REQUESTED TO SUGGEST THEIR CONSIDERED OPINION AND SUGGESTIONS THROUGH E-MAILS TO CHQ.


1. TRCA:

The TRCA proposed by the Nataraja Murti Committee for the GDS SPM/BPM and the GDS MD/SV have been based only on the pre-revised Mail overseer Postmen pay scales of 3200 and 3050 respectively. The GDS Committee ignored the recommendation of the 6th CPC which recommended upgradation of pay scales to Postmen from 3050 scale to 3200 scale and for Mail Overseer Postman the 3200 scale was elevated to 4000 scale. Thus the historical prorata comparison maintained by all earlier GDS Committees had been diluted by the Nataraja Murti Committee. Despite the Staff Side representation, the mistake has not been rectified by the Government. The dilution of Pro-rata wages to both GDS SPM/BPM and GDS MD/SV has resulted in a drop in TRCA computation for these two categories. This gross error has to be rectified by the Government.


2. FITMENT FORMULA:

Fitment Formula for regular CG Employees recommended by the 6th Pay Commission was Basic Pay as on 1.1.2006 multiplied by 1.74 and then grant of 40% the maximum of the pay scale as Grade Pay. The 6th CPC ignored the fact that due to merger of DA with Pay w.e.f. 1.4.2004 the Dearness Pay was earning Dearness Allowance. On the demand of the Staff Side, the Government allowed inclusion of the above quantum and implemented the fitment formula as follows: "Basic Pay as on 1.1.2006 multiplied by 1.86 and then grant of Grade Pay @ 40% maximum of pay scale of the employee.

The GDS Committee recommended a fitment formula to GDS Employees viz., the Basic TRCA as on 1.1.2006 multiplied by 1.74 times and then adding 40% of the maximum of the TRCA. The GDS Committee also thus ignored the fact that the GDS were granted 5% additional TRCA w.e.f. 1.4.2004 in lieu of 50% Merger of DA granted to CG Employees. The Staff Side pointed out this omission and ultimately the Government has implemented a fitment formula as follows: " Basic TRCA as on 1.1.2006 + 5% TRCA increase as on 1.4.2004 multiplied by a factor of 1.74 and then adding 40% of the 20th Stage of TRCA [viz., Maximum of TRCA] and fixing at the next higher level in the new TRCA". This inclusion of 5% TRCA in the fitment formula converts the factor into 1.82 which is just 0.04% below the CG Employees.

However, the mistake committed by the Government while calculating the 40% fitment to be allowed, a wrong calculation has been made in the case of GDS Mail Deliverer/ Stamp Vendor under Column 4 and 5 [Page 2]. There is an arithmetic error and instead of Rs.850/- fitment benefit for GDS MD / SV with 3.45 Hrs workload a sum of Rs.750/- has been granted. A sum of 100/- has been miscalculated. Similarly instead of Rs.1056/- fitment benefit to GDS MD / SV for work load above 3.45 Hrs, a sum of Rs.936/- has been granted. A sum of Rs.120/- has been reduced by miscalculation. These arithmetic errors have to be rectified by the Government.

3. OTHER ALLOWANCES:
The Government has ordered implementation of Allowances w.e.f. 9.10.2009 i.e., the date of the order. This should have been from 1.9.2008 as in the case of CG Employees because the date of effect of wage revision in the case of GDS also had been given effect to from 1.1.2006 only as like CG Employees.

4. SERVICE DISCHARGE BENEFITS:

Ex-gratia Gratuity shall not be less than the quantum permissible under Gratuity Act 1972 as ordered by different Court Judgments. The maximum of 60,000 shall be suitably revised upwardly to a maximum of 16 ½ months TRCA + DA to GDS employees on the date of their retirement.

The non-inclusion of Social Security recommended by Nataraja Murti in the Cabinet Memo for approval by the Cabinet is wrong. Nataraja Murti Committee had recommended for a Social Security Scheme wherein the Department of Posts is to deposit a sum of Rs.200/- per month throughout the service of the GDS and then on retirement a monthly payment of social security should be paid. This issue should have been sent for approval along with wage related issues. But this issue has been kept pending for further consideration. The delay caused in this issue would deprive the retiring GDS employees the benefit of Social Security after serving more than 30-40 years. The Social Security should be implemented with immediate effect instead of postponed consideration by the Government.

5. PRODUCTIVITY LINKED BONUS:

The contention of the Government Order that the present calculation of the Ex-grtia bonus by applying the calculation ceiling of Rs.2500 as basic + DA shall continue is based on a wrong concept placed on an unsustainable logic. The records show clearly that all previous bonus ceiling ordered by the Government by way of amendments to Bonus Act have been fully made applicable to GDS also. The departure had been made only from the recent amendment to Bonus Act allowing ceiling limit of 3500/-. The wrong orders issued by Department of Posts have been superseded by an another order but once again a wrong order was issued to supersede the superseded order. No consultation was made even with the MOF on this matter. The Bonus Ceiling for GDS also shall be Rs.3500/- and the dubious method followed to deny the benefit of Bonus Act shall be dropped.


6. TIGHETENING OF TIME FACTOR:

The recommendation of GDS Committee for tightening of time factor of cash counting from the present 1000/- = 1 Point into 20,000 = 1 Point is too harsh and unscientific. In spite of the stiff opposition to this unscientific and irrational norm suggested by the Nataraja Murti Committee, the Government has reportedly gone ahead unilaterally to accept this unjustified recommendation. This tightened time factor has to be given up and a rational norm like at least 5000/- = 1 Point has to be accepted.


7. ESTABLISHMENT RELATED ISSUES:

Once again it is not clear as to what decision the Government has taken with regard to various establishments related matters like relocating the GDS BOs etc recommended by Nataraja Murti Committee. It was pointed out earlier also that on establishment related issues, a deep study and mutual consultations with the Staff Side should be undertaken. The Government should not take any unilateral decision on any of the establishment related recommendations without subjective them to mutual study and scientific analysis.

These are the major issues in our opinion that are to be treated as Anomalies for settlement and effectively projected before the Government by the Postal Joint Council of Action for a settlement. However the GDS Unions in the Postal JCA have to come with their analysis and demands for chalking out a suitable Charter of Demands for placing before the Government for approval. The Postal JCA would meet on 28th October 2009 as already announced in the Office of the NFPE in New Delhi and discuss the GDS Committee implementation and also the pending issues of Postal Regular Employees that are to be taken up for immediate settlement.

GDS PAY COMMITTEE & CABINET APPROVAL

It is confirmed that the cabinet has accorded approval of the cabinet note submitted by the department with regard to implementation of GDS committee recommendations.

(i) The Finance Ministry has not conceded any one of the recommendations of the Gopinath committee and treated the Nataraja Murthy Committee as an expert Committee in respect of GDS.
(ii) However, it is reliably learnt that the 'Pay Fixation Formula' suggested by Gopinath Committee for including the 5% TRCA increase granted to GDS in lieu of 50% Merger of DA granted for CG Employees from 01.01.2004 has been approved for pay fixation.

The following, may be the cabinet decision on the issue of GDS committee report because these were the issues on which Cabinet Note was submitted for approval.

1. TRCA to GDS various categories: -
(i) GDS SPM - : Rs.4575-85-7125 (Annual increase Rs.85/-)
(ii) GDS BPM –
Up to 3 hours work (75 points) : Rs.2745-50 (increment)-4245

After adding all the above three elements, the pay shall be fixed at a stage in the TRCA next above the amount arrived.

NB: - For C.G. Employees, it was 1.86 times of basic pay as on 01.01.2006. It is stated that the increase for GDS will arrive at 1.827 times as per the above fixation formula.

5. Combined Duty Allowance : Rs.500/- per month
6. Severance Amount : Rs.60000/- Maximum

6. Gratuity : Rs.60000/-
7. Group Insurance Scheme : Rs.50000/-

8. Allowance for remitting cash : Rs.50/- (for remittance exceeds Rs.30000/-)

9. Allowance for detention beyond duty : Minimum Rs.6/- per day (maximum Rs.12/-)

10. Retirement age will continue to be 65 instead of 62 suggested by Nataraja Murti Committee.

Further it is learnt that the Finance Minister has rejected the claim of enhancement of Bonus ceiling to GDS to Rs.3500/- and confirmed that it should be Rs,.2500/- only.

The other Features: -
(i) The Department may process the insurance coverage for medical treatment to GDS with the maximum coverage of Rs.30000/- per year.
(ii) No pension scheme was formulated in this approval.
(iii) Now 40% arrears alone will be paid as first instalment out of the total arrears for 45 months. The balance will be paid in the next financial year.
(iv) The Department may cause orders to implement the revised norms recommended by the GDS committee in cash handling (i.e) 1 point for Rs.20000/- which will certainly affect the interest of BPMS. Gopinath Committee's recommendations were not considered on this issue.
(v) The orders on the above are expected in the next week probably after 13.10.09.
